US lawgivers will caff
special counsel Robert Hur on Tuesday, weeks after his report into Mr Biden’s running of classified documents shook Washington.
The report found that Mr Biden “knowingly” retained the files, but declined to charge him with a crime.
Mr. Hur said the jury would see the president as a “well-intentioned, elderly man” with a failing memory, comments that angered the White House.
Voters’ concerns over Mr Biden’s age mean Republicans will focus on the comments.
The party has been claiming for months that the 81-year-old is not mentally fit to run for a second term in the White House, with polling showing that a significant portion of voters are also concerned about Mr Biden’s mental acuity.
Mr. Hur alleged in his February report that the President struggled to remember major events of his tenure as Vice President, and that he could not even remember when his term in office began.
The President immediately denied reported claims that he was suffering from memory problems, telling reporters: “I’m well-intentioned, and I’m an older man, and I know what I’m doing.”
While the special counsel said Mr. Biden “knowingly” retained many of the documents, some of which he stored in unsecured locations, including his garage, the jury was unlikely to convict him.
But the Republican Party continues to attack Mr. Biden! And he has criticized Mr. Hur’s refusal to press charges, comparing it to similar charges filed against former President Donald Trump.
“Having a poor memory does not absolve you of violating the Espionage Act. Being old and elderly does not absolve you of violating the Espionage Act,” Florida Representative Byron Donalds said on Fox News on Sunday.
Republican strategist and pollster Dan Judy told the BBC the party would certainly use the proceedings before the House Judiciary Committee on Tuesday to compare the treatment of the two men. He suggested Mr Trump’s allies might characterize the decision to charge him as “partisan witchcraft” and not Mr Biden.
“Now, the details are not the same in both cases, but I can see Republican members trying to push that argument,” he said. “Something like ‘You looked at this and decided not to impeach President Biden and yet President Trump has been accused of the same thing.'”
In June, Mr. Trump was charged with seven counts of handling classified documents after leaving the White House, with a trial potentially scheduled for this summer.
House Republicans have also asked Mr. Hur to turn over recordings and documents and transcripts of his interviews with Mr. Biden that he made during his year-long tenure.

US media reported that White House officers were sprucely overcritical of Attorney General Merrick Garland, who designated Mr Hur.
